The Court of Cassation, posting, with the decision No. 3785 of 2009, indicated the conditions necessary to obtain damages for bullying which can be summarized into 4 main points: 1. There should be a "multiplicity of character behavior as persecution, unlawful or lawful if taken separately, have been put in place in a systematic and sustained way in targeted against the employee with intent vexatious"; 2. "The event must be detrimental to the health or personality of the employee; 3. There shall be a "causative link between the conduct of the employer or immediate superior and the psycho-physical injury to the worker"; 4. persecutory intent must be proved. |
